These Terms and Conditions ("Agreement") govern your use of the web hosting and cloud services ("Services") provided by Ndovuhost.com ("we," "us," or "our"). By using our Services, you ("User" or "you") agree to be bound by these terms.

1. Definitions

• "Services": The web hosting and cloud services provided by Ndovuhost.com.

2. Service Description

Ndovuhost.com provides a variety of hosting solutions, including:

• Shared Hosting
• Virtual Private Servers (VPS)
• Dedicated Servers

Each Service comes with specific features, resource allocations, and limitations outlined in your service agreement.

3. Payment and Billing

• Services are billed on a monthly or annual basis, as chosen during registration.
• Payments are due in advance and can be made via credit card, bank transfer, or mobile money.
• Failure to pay on time may result in suspension or termination of Services.

4. Acceptable Use Policy

You agree not to:

• Host illegal, prohibited, or infringing content.
• Engage in spamming, phishing, or other abusive activities.
• Attempt to hack, disrupt, or overload our Services.
• Use the Services to violate any applicable laws.

Violations may lead to immediate suspension or termination of your Services without prior notice.

5. Intellectual Property

• You retain ownership of your content uploaded to our Services.
• Ndovuhost.com grants you a non-exclusive, revocable license to use our Services for hosting purposes.
• You must not infringe on the intellectual property rights of others.

6. Limitation of Liability

To the fullest extent permitted by Kenyan law, Ndovuhost.com is not liable for:

• Loss, corruption, or unauthorized access to your data.
• Service interruptions due to force majeure events (e.g., natural disasters, cyber-attacks).
• Indirect, consequential, or incidental damages arising from the use of our Services.

7. Termination

• You may terminate your Services by providing 30 days' written notice.
• We may terminate your Services for breach of this Agreement or non-payment, with or without notice.
• Upon termination, you must remove your content from our servers.

8. Data Protection

We process personal data in accordance with the Kenyan Data Protection Act and our Privacy Policy (see below).

9. Governing Law and Dispute Resolution

• This Agreement is governed by the laws of Kenya.
• Any disputes will be resolved through mediation or arbitration in Kenya, unless otherwise required by law.

10. Changes to Terms

We may update these Terms and Conditions periodically. We will notify you of significant changes via email or on our website.

11. Hosting Services Refund

30-Day Money-Back Guarantee: Ndovuhost.com provides a 30-day money-back guarantee for our hosting services only. If you are not satisfied with your hosting service, you may request a refund within 30 days of your purchase.

Free Domain Name Condition: If your hosting service included a free domain name as part of the package, the amount that would have been incurred to register the domain separately will be deducted from your refund. This means your refund will be less the price of the domain.

Exemption for .co.ke Domains: If the domain name involved is a .co.ke, the full amount will be refunded without any deduction.

12. Domain Name Purchases

No Refunds for Domain Names: Ndovuhost.com does not offer refunds for purchases of domain names, as we incur nearly equivalent costs to pay the registry.

Exemption for .co.ke Domains: Refunds for .co.ke domains are available if requested within 28 days of purchase. Refunds for qualifying .co.ke domain-only purchases requested after 28 days will not be processed.

13. Refund Processing Schedule

Refunds are processed on Fridays. If you request a refund, it will be paid on the first Friday following your request.

If your request is made on a Friday, the refund will not be processed on the same day but will be handled on the following Friday.

14. How to Request a Refund

To request a refund, please contact our customer support team at support@ndovuhost.com or via our website’s support portal.

Provide your account details and the reason for your refund request.

Approved refunds will be credited back to the original payment method used for the purchase.

15. Additional Terms

Refunds are subject to the terms and conditions of our service agreement and this Refund Policy.

Ndovuhost.com reserves the right to deny a refund if the request is deemed to be in bad faith or if you have violated our terms of service.
